Whipple-Lue’s lawyer wants judge removed

MACON, Georgia (41NBC/WMGT) – Mary Ann Whipple-Lue’s attorney says the hearing that resulted in her suspension was illegal, and he’s asking for the judge who suspended her to be removed from the case.

Wayne Kendall filed a motion Monday in Wilkinson County Superior Court asking for the removal of Judge Robert S. Reeves.  Kendall says he didn’t even know the 3 p.m. hearing was happening last Monday until after 1:30.

“When I asked about the purpose of the hearing when they called me about it, the only thing they told me was that the purpose of the hearing was to prevent the mayor from voting unlawfully in a manner that was not already prescribed by the charter,” Kendall says.  “Then when I get the order, the mayor is suspended, under circumstances where I could have not possibly been at the hearing.”

Kendall says with such short notice, he couldn’t have made the 100-plus mile trip from Atlanta to Irwinton.  He also accuses Reeves of having inappropriate contact with the plaintiffs in the case, “The Concerned Citizens of Gordon” and council members Terry Eady and Freddie Densley.

Eady is serving as Mayor Pro Tem.  Another hearing is scheduled for June 24.
