State sets termination hearing for Macon Charter Academy

MACON, Georgia (41NBC/WMGT) – Macon Charter Academy has a termination hearing with the state in August.

The Georgia State Board of Education told MCA it has to prepare a witness and document list of the evidence the school plans to present at the hearing.

The Georgia Department of Education must do the same.

That evidence must be submitted to the hearing officer and opposing counsel by 5 p.m. on August 11, according to the letter sent from the state to MCA.

Both parties are also required to provide copies of all exhibits at the hearing for the hearing officer, the chair and each member of the state board.

MCA and the state DOE can request a pre-hearing telephone conference.

They must make a request identifying specific issues by August 4th.

The letter from the state to MCA says “state law provides that the State Board may terminate a charter if the State Board finds a failure to: adhere to material terms of the charter school’s charter contract; meet generally accepted standards of fiscal management; follow applicable federal, state or local laws or court orders; or the existence of competent substantial evidence that the continued operation of the charter school would be contrary to the best interests of the students or the community.”

The state DOE claims MCA has met each of those conditions.

The hearing will be August 18 at 1 p.m.
