Georgia Supreme Court Rules Against Bibb County Checkpoint Policy
MACON, Georgia (41NBC/WMGT)– The Georgia Supreme Court ruled today that Bibb County’s policy it uses to conduct roadblock checkpoints is too broad and that a roadblock in 2010 violated a man’s fourth amendment rights. Today’s ruling reversed an opinion from a lower court.
Justices considered if the decision to implement that roadblock was made by a supervisor, and if it had a legitimate primary purpose.
They decided that the officer who made the decision about the checkpoint was correct to do so, but that Bibb County’s written checkpoint policy is not specific enough as required by the constitution.
