Cooke to Seek Death Penalty Against Suspect in Gail Spencer Murder

MACON, Georgia (41NBC/WMGT) – Macon Judicial Circuit District Attorney David Cooke is seeking the death penalty against a woman accused of killing her co-worker last October.

Tracy Michelle Jones is accused of killing Gail Spencer. Jones worked with Spencer at Calder Pinkston & Associates, along with three other people also accused in Spencer’s murder. Cooke says there are four factors that allow the State to seek the death penalty. He says Jones plotted to imprison and murder Spencer in her own home, so she and her co-conspirators could steal money from their employer. He calls it an “outrageously vile and horrible cime, and its effects will linger on Ms. Spencer’s family and our community for years to come.”

“Those who plan and commit violent and abhorrent crimes and show no remorse are the most dangerous and deserve the ultimate penalty,” Cooke went on to say.

Michael Brett Kelly, Keith Anthony Dozier, and Courtney Nicole Kelly are also accused along with Jones of malice murder, theft by taking, aggravated assault, 1st degree burglary, and false imprisonment.

Michael Kelly was charged last week with aggravated sodomy for allegedly sexually assaulting the victim. 41NBC asked Cooke what sentence he is seeking for the other suspects. He said as for Michael Kelly, he expects him to plead guilty to the charges against him on Monday. He also is set to testify against Jones. If he meets all of these conditions, he can avoid the death penalty and be sentenced to life without parole.

There is still no word on what sentence Cooke is seeking for the other suspects.

Authorities say they broke into Spencer’s home on October 5th 2012 to steal the money from their employer, which she had. Spencer was suffocated with a plastic bag.

Cooke says Jones will be arraigned Monday, May 13 at 3pm in front of Judge Howard Simms. 41NBC will be there and will have the latest.
