McDaniel’s Attorneys: Need More Time to File Motions, Missing Evidence
MACON, Georgia (41NBC/WMGT) — Lawyers for Stephen McDaniel, the man accused of killing and dismembering Mercer Law graduate Lauren Giddings, asked a judge for more time to file motions Monday, because they’re missing evidence.
One of McDaniel’s attorney’s, Franklin Hogue says his team is still waiting on the results of DNA testing. Hairs that were found on Giddings’ torso and in the refrigerator of the apartment below hers were sent to the FBI crime lab for testing. Hogue says he hasn’t seen the results of that testing.
Hogue doesn’t believe prosecutors or law enforcement are hiding evidence. He says missing reports, and evidence are common in a case this large.
On December 14th, 31 motions were filed from the 1100 pages of reports in the case. Hogue says there wasn’t enough time to get all the requests in, and another wave of 30 motions could be filed in regards to this case. He’s asked the judge for a new deadline of April 30th.
