Cooke Seeking Death Penalty Against Kelly

MACON, Georgia (41NBC/WMGT) – Bibb County district attorney David Cooke announces he intends to seek the death penalty for Michael Brett Kelly.

Kelly was charged with murder in the death of Gail Spencer on October 5, 2012. He filed a motion to withdraw his guilty plea, which was entered on May 13.

That plea agreement from last month said Kelly would testify against his co-defendants in this case in exchange for a life sentence without parole. Part of the agreement also said if Kelly broke the deal, Cooke would re-indict him and seek the death penalty.

“As I’ve said before, those who plan and commit violent and abhorrent crimes and show no remorse are the most dangerous and deserve the ultimate penalty,” Cook said at a press conference Wednesday. The District Attourney’s Office is fully committed to bringing each person responsible for those crimes to justice.”

“Another hearing is set for Monday, June 24 at 4:00 p.m.
