McDaniel’s Defense Files Motion To Ban Wearing Color Pink During Trial

MACON, Georgia (41NBC/WMGT) — Stephen McDaniel’s lawyers filed a motion asking the court to prohibit wearing the color pink during trial. McDaniel is accused of killing Mercer Law graduate Lauren Giddings in June 2011.

After filing 17 new motions late Thursday, lawyers Floyd Buford and Franklin Hogue added one more motion to the pile Friday afternoon. The latest motion stated, “This motion pertains only to the wearing of pink when jurors are in the courthouse for jury selection and the trial of this case.”

According to the document, Giddings’ favorite color was pink. Her friends and family wear pink each time they attend hearings to show their support and to honor her memory. McDaniel’s defense argued that “every accused citizen is entitled to a trial by an impartial jury,” adding that having a jury exposed to a “sea of pink solidarity” could create a sympathy for Giddings and influence how the jury reviews the evidence during the trial.

McDaniel pleaded not guilty to killing Giddings. A trial has been scheduled for September 2013.
