Judge James Boasberg, who issued the order late Saturday evening, directed the administration to halt the use of the Alien Enemies Act to deport individuals without hearings. However, reports indicate that the White House proceeded with deportations over the weekend, citing the use of the wartime law to remove alleged gang members from U.S. soil.

In response to the controversy, White House Press Secretary denied any violation of the judge’s directive, claiming that those deported were already outside U.S. territory by the time the written order was issued. However, the administration’s response fails to address the judge’s earlier comment, which demanded that any flights transporting individuals involved in deportations should be turned around immediately.

“They are looking to push the bounds, and they have no problem doing this,” said Amie Parnes, Senior Correspondent for The Hill. Legal experts have pointed to the critical issue surrounding whether the flights were in U.S. territory at the time the judge gave his mandate. According to some analysts, if any planes involved had left U.S. soil after the judge’s verbal order, this could constitute a violation of the mandate.

Elie Honig, a former Assistant U.S. Attorney, explained the situation: “Now we’re going to get into a gray area,” as the exact timing and location of the flights when the judge’s verbal order was issued could be key to determining whether the administration’s actions were legally sound.

This legal battle is shaping up to have broader implications. Experts argue that it could ignite a court fight over the administration’s controversial practice of deporting individuals without hearings, raising concerns about the limits of executive power in relation to judicial authority.

Conservative political figures, such as KT McFarland, a Board Member at the Conservative Political Action Conference (CPAC), have suggested that the administration’s actions reflect the president’s firm stance on immigration enforcement, even if it means challenging judicial oversight. “A bad pun, but it trumps every other legislation that we have,” she remarked.

At the same time, the situation raises serious questions about the Trump administration’s willingness to adhere to judicial mandates. Axios Senior Contributor Margaret Talev remarked, “It does raise questions about whether President Trump and his team are going to follow judge’s orders.”
