DUBLIN, Georgia (41NBC/WMGT) – A former Dublin KFC employee is suing the restaurant’s owner for discrimination after she was fired in July of 2015.
Former store manager Cynthia Dunson says the owner of Hester Foods, Inc. violated federal law by firing her when he found out she took prescribed medicine for bipolar disorder.
The owner used obscene terms to describe the medicine and made her flush it down the toilet at the restaurant.
When Dunson told him later she would keep taking the medicine based on what her doctor said, he told her not to come back to work and fired her.
If this is true, the EEOC news release says, this behavior would violate the Americans with Disabilities Act.
The EEOC filed suit in the U.S. District Court for the Southern District of Georgia after it tried to reach a settlement in the case.
The agency is looking for back pay, compensatory damages and punitive damages for Dunson, as well as injunctive relief to prevent discrimination in the future.
“Managers and owners cannot force employees to forego medical care or prescribed medications to keep their job,” said Bernice Williams-Kimbrough, director of the EEOC’s Atlanta District Office.
Antonette Sewell, regional attorney for the Atlanta District Office, added, “Whether an employee works for a large corporation or a local restaurant, she has a right to be protected from discriminatory actions by employers. We want employers of all sizes to understand their duties under the law and for employees to report such actions when they occur.”
The EEOC advances opportunity in the workplace by enforcing federal laws prohibiting employment discrimination.
